Article 1 - DESCRIPTION OF THE LEASED PROPERTY
The landlord rents to the tenant the holiday home located at:
Carrer de Milfulles 12, 03739 Jávea, Spain, hereinafter referred to as “the rented property”.
The rental agreement is concluded via the online booking system (Smoobu) and applies exclusively to temporary recreational use.
Article 2 – DESTINATION & USE
- The rented property may only be used as a holiday home.
- Permanent residence is not permitted.
- Groups of young people and party groups are not permitted.
- Smoking in the property is not permitted.
- Nuisance to local residents is not permitted.
- The maximum number of guests stated in the reservation may not be exceeded.
- It is not permitted to produce content of a pornographic and/or sexual nature in and around the property.
- It is not permitted to charge electric cars using the property's power supply.
- If the tenant does not comply with the house rules, the agreement may be terminated with immediate effect and additional costs may be charged.
Article 3 – DURATION OF THE AGREEMENT
- The rental period is as stated in the booking confirmation.
- On the agreed day of arrival, the tenant can occupy the accommodation from 4:00 PM, unless otherwise agreed.
- On the day of departure, the tenant must vacate the accommodation by 10:00 AM.
- The agreement ends automatically after the agreed rental period.
- Minimum stay: 7 nights (unless otherwise agreed).
Article 4 – RENTAL PRICE AND ADDITIONAL COSTS
1. Rental price: The total rental price will be stated during the booking process.
2. Payment
- 50% deposit within 4 days after booking.
- Remaining amount no later than 4 weeks before arrival.
- If payment is not made, the reservation may be cancelled.
3. Borg
- The deposit is €500.
- The deposit will be refunded within 7–14 days after departure, minus any damages, extra cleaning or additional costs.
4. Mandatory additional costs
- Cleaning: €250 per stay Bed linen: €25 per person per stay Electricity: €15 per person per stay Normal consumption is included. Excessive consumption may be charged.
Article 5 – CANCELLATION
If the tenant wishes to cancel the booking for any reason, the tenant must always confirm this to the landlord by email (even if this has already been communicated to the landlord by phone, for example). The landlord will charge the following amounts, depending on the date of the written cancellation by the tenant:
- Cancellation more than 3 months before the start of the rental period: free of charge.
- Cancellation between the 90th and 60th day before the start of the rental period: 25% of the rental price.
- Cancellation between the 59th and 30th day before the start of the rental period: 50% of the rental price.
- Cancellation less than 30 days before the start of the rental period: 100% of the rental price.
If the tenant only gives notice on the starting date or during the rental period that he or she will no longer be using the rented property, he or she will still be liable to pay the full rental price.
If the tenant has not arrived within 24 hours of the agreed date and without further notice, this will be considered a cancellation.
A tenant can only transfer a reservation to another person if this has been agreed upon in writing with Mil Sueños and after providing the necessary information for the new tenant. Changes to additional guests are also possible upon written agreement.
If the landlord is unable to proceed with the stay due to force majeure (such as natural disasters, government measures, or serious damage to the property), the maximum amount of rent already paid will be refunded. Further compensation is excluded.
Article 6 – CONDITION OF THE LEASED PROPERTY
- The rental property is provided in good condition.
- Any defects must be reported immediately upon arrival.
- The rental property must be left tidy and well-maintained.
- Excessive soiling may be deducted from the deposit.
Article 7 – PROHIBITED USE
- It is not permitted to: Charge electric cars using the home's electrical system.
- Sublet or allow third parties to use the property.
- Organize parties or events without permission.
- Violation may result in immediate termination without refund.
Article 8 – SWIMMING POOL AND FACILITIES
- Use of the pool and other facilities is entirely at your own risk.
- There is no supervision.
- Parents/guardians are fully responsible for minors.
- Glassware is not permitted near the pool.
Article 9 – PETS
Pets are not allowed. t
Article 10 – LIABILITY
The tenant is liable for all damage caused by himself or fellow travelers.
The landlord is not liable for:
- Loss or theft of property
- Accidents in and around the home
- Water, electricity, or internet disruptions
- Damage due to force majeure
- Use of the swimming pool, stairs, barbecue, and other facilities is entirely at your own risk.
Article 11 – IDENTIFICATION and LEGAL REGISTRATION
- The tenant is obliged to provide valid identification for all guests before arrival.
- The landlord is entitled to register this information in accordance with Spanish legislation on tourist rentals.
Article 12 – PRIVACY
Personal data will only be used for reservation and legal registration and will not be provided to third parties, unless legally required.
Mil Sueños or a designated party has access to the property at all times in case of emergencies or repairs. If possible, this will be discussed with the renter in advance or announced.
Article 13 – APPLICABLE LAW
- This agreement is governed by Dutch law, unless mandatory Spanish law prescribes otherwise.
- Disputes will be submitted to the competent court.
